Shyamal Misra Gets Ex-Post Facto Approval for Additional Charge as Additional Secretary in Department of Telecommunications

The Appointments Committee of the Cabinet (ACC) has accorded ex-post facto approval for the entrustment of additional charge of the post of Additional Secretary in the Department of Telecommunications (DoT), Ministry of Communications, to Shri Shyamal Misra, IAS (HY:1996). Misra has been handling the additional responsibility alongside his existing assignment as Administrator, Digital Bharat Nidhi, in the Department of Telecommunications.

According to an order issued by the Secretariat of the Appointments Committee of the Cabinet on October 2, 2026, the approval covers the period from April 27, 2026, to December 31, 2026. The arrangement will continue until the appointment of a regular incumbent or until further orders, whichever is earlier.

ACC Gives Ex-Post Facto Approval to Shyamal Misra’s Additional Charge

The latest decision formally approves the additional charge already entrusted to Shyamal Misra for the senior post of Additional Secretary in the Department of Telecommunications. The term “ex-post facto approval” means that the competent authority has now formally approved the arrangement for the period during which Misra has already been performing the additional responsibility.

The approved period begins from April 27, 2026, and runs up to December 31, 2026, unless a regular incumbent is appointed before that date or another government order brings the arrangement to an end earlier. The order therefore provides a clear framework for Misra’s temporary additional responsibility while leaving room for an earlier appointment to the regular post.

The ACC order does not describe this as a permanent appointment to the Additional Secretary post. Instead, it specifically records the entrustment of additional charge to Misra for the stated period and under the conditions mentioned in the official communication.

Who Is Shyamal Misra?

Shri Shyamal Misra is identified in the ACC order as an IAS officer of the 1996 batch belonging to the Haryana cadre. His present assignment is as Administrator, Digital Bharat Nidhi, Department of Telecommunications.

Alongside this existing responsibility, he has been entrusted with the additional charge of Additional Secretary in the Department of Telecommunications. The latest ACC approval formally covers this arrangement from April 27, 2026.

The order itself does not provide a detailed career profile of Misra, nor does it list the specific responsibilities he has been handling as Administrator, Digital Bharat Nidhi. Therefore, the latest government communication is primarily an administrative order concerning his additional charge and its formal approval.

Additional Charge at a Senior Level in DoT

The Department of Telecommunications functions under the Ministry of Communications and deals with important areas relating to the country’s telecommunications administration and policy framework. Within the department, the position of Additional Secretary is a senior administrative post.

Shyamal Misra has been handling this responsibility in addition to his existing assignment as Administrator, Digital Bharat Nidhi. The ACC’s ex-post facto approval now formally validates the arrangement for the period specified in the order.

The additional charge is not open-ended. The order clearly states that the arrangement will remain effective from April 27 through December 31, 2026, or until the appointment of a regular incumbent, or until further orders, whichever is the earliest.

This condition means that the temporary arrangement could end before December 31 if a regular Additional Secretary is appointed or if the competent authority issues another order concerning the post.

What Is Ex-Post Facto Approval?

The phrase “ex-post facto approval” is important in this order because the additional-charge arrangement dates back to April 27, 2026, while the formal ACC approval has been issued on October 2, 2026.

In administrative terms, the approval therefore relates to an arrangement covering a period that has already commenced. The ACC has now formally approved the entrustment of the additional charge for the specified period.

The order does not indicate why the additional charge was initially required from April 27 or why the formal approval was issued at this stage. It simply records that the ACC has accorded ex-post facto approval for the entrustment of the additional charge to Misra.

No additional reason or background concerning the vacancy or circumstances leading to the arrangement has been provided in the document.

Existing Assignment as Administrator, Digital Bharat Nidhi

At the time of the ACC approval, Misra is serving as Administrator, Digital Bharat Nidhi, in the Department of Telecommunications. The latest order specifically mentions this existing assignment while recording his additional charge as Additional Secretary.

This means the latest decision does not replace his existing posting. Rather, the Additional Secretary responsibility has been entrusted to him alongside his present role.

The order also does not state that Misra has been appointed as the regular Additional Secretary. The arrangement remains an additional-charge assignment and is subject to the appointment of a regular incumbent or further government orders.

Tenure Could End Before December 31

One of the important clauses in the ACC order is the condition attached to the period of additional charge. Although December 31, 2026, has been specified as the outer date, the arrangement is also linked to the appointment of a regular incumbent.

If a regular Additional Secretary is appointed before December 31, Misra’s additional charge would end at that point. Similarly, the competent authority can issue further orders that could alter or discontinue the temporary arrangement.

The official wording therefore establishes three possible endpoints: December 31, 2026, the appointment of a regular incumbent, or further orders. Whichever occurs first will determine the end of the approved additional-charge period.

Order Issued by ACC Secretariat

The communication was issued by the Secretariat of the Appointments Committee of the Cabinet, under the Ministry of Personnel, Public Grievances and Pensions and the Department of Personnel and Training.

The order was issued from New Delhi on October 2, 2026. It carries the file reference No. 36/02/2026-EO(SM-I). The order has been signed by Annie(s) Kanmani Joy, Director, who is listed with telephone number 2401 0544.

The formal communication records the ACC’s approval and has been circulated to a wide range of senior government offices, departments and constitutional authorities.

Order Circulated to Senior Government Officials

Copies of the order have been sent to the Cabinet Secretary and the Principal Secretary to the Prime Minister. The Secretary to the President of India and the Secretary to the Vice President of India have also been included in the circulation.

The Secretary General of the Rajya Sabha Secretariat and the Secretary General of the Lok Sabha Secretariat have also been informed. Copies have additionally been sent to the Secretary, Department of Personnel and Training, and the Secretary (Coordination & PG), Cabinet Secretariat.

The communication has also been circulated to all Secretaries to the Government of India as per the standard list. The Private Secretary to the Home Minister, Private Secretaries to all Union Ministers and the Private Secretary to the Minister of State for Personnel have also been included.

Cabinet Secretariat and PIB Also Informed

The officer concerned has been included in the circulation, along with the Chief Secretaries of all States. The Cabinet Secretariat has also been informed through Ms. Kavita Singh, Joint Secretary, with reference to Deputy No. 02/04/2026-CS(A) dated October 2, 2026.

The Director General (Media & Communication), Press Information Bureau, has also received a copy of the order. It has further been circulated to the Editor, Civil Services News and the Deputy Secretary, Department of Administrative Reforms and Public Grievances.

The remaining distribution includes the Principal Staff Officer to the Secretary (Personnel), Principal Private Secretary to the Establishment Officer, EO(CM), the guard file and the National Informatics Centre in DoPT.

The ACC’s latest decision formally approves the additional charge of Additional Secretary, Department of Telecommunications, entrusted to Shyamal Misra from April 27, 2026. The approval is retrospective in nature because it has been issued after the additional-charge arrangement had already commenced.

Misra will continue to hold the additional responsibility alongside his existing assignment as Administrator, Digital Bharat Nidhi, according to the order. The arrangement has been approved up to December 31, 2026, but it can end earlier if a regular incumbent is appointed or if further orders are issued.

The latest communication does not announce a permanent appointment to the Additional Secretary post. Instead, it provides formal ex-post facto approval for the temporary additional-charge arrangement and sets out the conditions under which that arrangement will continue.

For now, the key administrative development is that the ACC has formally approved Shyamal Misra’s additional charge as Additional Secretary in the Department of Telecommunications for the specified period, ensuring that the senior post remains under temporary charge until a regular incumbent is appointed or another government order changes the arrangement.
